Burma Preview: The People to Watch in 2013

2012 was an important year for Burma, also known as Myanmar, as it made significant progress in its political and economic transformation. Successful by-elections brought Aung San Suu Kyi’s opposition National League for Democracy (NLD) into Parliament, and the United States and Europe removed key sanctions and began looking to Burma as a potential place for investment.

The progress was underscored by visits from U.S. president Barack Obama and U.K. prime minister David Cameron. It was not, however, without setbacks, including reoccurring violence in Rakhine State, a brutal crackdown on peaceful demonstrators at the Letpadung copper mine, and increased offensives against the Kachin Independence Army in northern Kachin State, which included the use of fighter jets and attack helicopters.

We all hope Burma is better in 2013 and beyond. However, there are many challenges and obstacles ahead. First, the judiciary system is still not independent and impartial. It serves at the pleasure of the regime, and incompetent judges are running kangaroo courts. Second, the country’s economy is still dominated and controlled by the military, crony capitalists, and families of the regime. There is no chance for ordinary citizens to compete with them on a level playing field. And third, the Burmese military is still above the law and dominant in the country’s political affairs with unchecked powers. This post examines the heads of government, Parliament, and the military to provide a preview for 2013.


Thein Sein, Shwe Mann, and Min Aung Hlaing: 

Current president Thein Sein and Speaker of the Lower House Shwe Mann are former generals and were powerful figures in the previous military regime, known as State Peace and Development Council (SPDC). Both are now leaders of the ruling Union Solidarity and Development Party (USDP). Min Aung Hlaing, a junior general when Shwe Mann and Thein Sein numbered three and four in the SPDC, is now serving as the commander-in-chief of the armed forces. They are now running the three power centers: the government, the Parliament and the military, separately.

Although Thein Sein is the head of the government, he does not own all of his cabinet. The ministers of defense, home affairs, and border area affairs are appointed by Min Aung Hlaing. Shwe Mann is the head of the Lower House and will become the speaker of the Union Parliament, a combination of both houses, in June 2013, but does not own all of Parliament either. Twenty-five percent of the Union Parliament is military officials appointed by Min Aung Hlaing. The 2008 constitution allows for Min Aung Hlaing to run the military independently.

Among the 11 members of the country’s most powerful body, the National Defense and Security Council (NDSC), Min Aung Hlaing controls six members: himself, his deputy commander-in-chief, the ministers for defense, home affairs, and border area affairs, and one of Burma’s two vice presidents. Apparently, he is the most powerful person in Burma.

Though these three men are all on the same side, in reality they are fighting each other. Thein Sein wants to consolidate power to his presidency. Shwe Mann has tried hard to undermine Thein Sein through parliamentary maneuvering, and is presenting himself as the best presidential candidate for the 2015 election. Neither man will succeed without the support of Min Aung Hlaing, but neither one has won him over.
When Senior General Than Shwe, who led Myanmar and the SPDC prior to reforms, selected Min Aung Hlaing to lead the military, it was a jump promotion. Initially, he was very quiet and unable to avoid the influence of the more senior Thein Sein and Shwe Mann. Gradually, he seems to have realized the magnitude of power the 2008 constitution gave him.

Min Aung Hlaing began consolidating his power base in the military by replacing regional commanders and top military figures who were his contemporaries with his loyalists. Now he knows very well that he is much more powerful than Thein Sein and Shwe Mann, and is exercising his power by not listening to their orders. He does not need to become involved in the competition between Thein Sein and Shwe Mann. He does not need to support anyone, but he will oppose anyone who tries to amend the 2008 constitution that gives him supreme power, or those who try to attack Senior General Than Shwe, who gave him this position.

Although Thein Sein, Shwe Mann, and Min Aung Hlaing are competing for power, they all have one thing in common: they all know that they need to use Aung San Suu Kyi to some extent. Thein Sein knows that giving her political space will help normalize relations with western democracies that were major critics of the military regime. Shwe Mann knows that giving her some leading role in the Lower House will help strengthen his image and his dream for the presidency. Min Aung Hlaing knows that recruiting her to lead the Investigative Commission on the Mount Letpadaung Copper Mine Project could save the military-owned business empire and its joint-venture projects with Chinese companies from future public criticism and protests.

As political norms begin to crystallize throughout 2013, the power struggles between these three men will play a major role in the development of Burma’s institutions and their legacies. This year will be critical in determining whether Burma’s branches of government can work together cohesively or if one will dominate over the other two, and thus shape the state’s trajectory for years to come.

Myanmar has undergone dramatic changes since the newly installed quasi-civilian government took power in 2011. President Thein Sein admitted that the country is in bad shape in every sector due to corruption, mismanagement and a decades-long civil war. He initiated limited political and economic reform by engaging with political dissidents, and opening up the economic and financial system to become realistic and competitive.

The conventional wisdom of the peoples of Myanmar is that such a reform process would create a level playing field in the economy and diminish crony capitalists, who had controlled the country's economy for more than 20 years with the help of the previous military regime, albeit gradually. Sadly, the opposite is true.
The cronies have reinvented themselves to fit in with the new playing field. Many of them are now members of parliament and leaders of the ruling Union Solidarity and Development Party (USDP), cabinet ministers, presidential advisers and peace brokers _ some have even declared that they are now philanthropists.
After the United States, European Union (EU), Canada and Australia suspended or lifted economic and trade sanctions with the support of Aung San Suu Kyi, the wealth and business empires of the crony capitalists have been expanding greatly with the return of foreign investments to Myanmar and increased export opportunities to the international community. For foreign investors, they have no choice but to work with the cronies as they own most of the country's land, buildings, banks, factories and other economic resources as well as having government connections.

The cronies are also now favourites of Mrs Suu Kyi who said on Jan 9 this year: "If those so-called cronies render assistance for social work, we agree with them and [we welcome] their sincere contribution. Instead of spending money for useless activities, the money can be put to good use; it is a good idea."
Her party, the National League for Democracy (NLD), held a fund-raising music festival for its education network on Dec 27 and 28, 2012. The event was sponsored by companies including Air Bagan and the Asia Green Development Bank (AGD), owned by Myanmar business tycoon Tay Za, and SkyNet, a cable company owned by Shwe Than Lwin Kyaw Win who is under EU sanctions. Those companies donated more than US$240,000 (7.2 million baht) for the education network of the NLD, in addition to providing the venue for the NLD's press conference. SkyNet is a business partner of Voice of America (VOA), a US Federal Agency, which is now broadcasting its TV programmes in Myanmar through SkyNet TV.

The Myanmar military has continued its offensives against the Kachin Independence Organisation (KIO), the ethnic Kachin resistance group, in Kachin state. Despite the fact that this has resulted human rights abuses including sexual violence and in more than one hundred thousand refugees fleeing from and suffering great hardship in the war zone, Aung San Suu Kyi continues to profess her love for the Myanmar military.
On Jan 28, 2013, she spoke to the BBC saying that "It's genuine. I'm fond of the army. People don't like me for saying that. There are many who have criticised me for being what they call a poster girl for the army. Very flattering to be seen as a poster girl for anything at this time of life, but I think the truth is I am very fond of the army, because I always thought of it as my father's army."

She is not alone. The cronies love the army just as much. On Jan 27, 2013, AGD Bank, the same bank that sponsored the NLD's fund-raising event, proudly donated US$90,000 to soldiers from the Myanmar army under the Northern Military Command who are fighting on the front lines in Kachin state.

By taking money from the cronies, defending them from public criticism and showing love for the Myanmar military, Mrs Suu Kyi has effectively irritated ethnic populations, especially the Kachin who have suffered enormous human rights violations by the Myanmar army in their state. One of the Kachin community leaders, Khon Ja, recently said: "Her [Aung San Suu Kyi's] focus is collecting awards and becoming president, rather than the suffering of our people."

Mrs Suu Kyi's supportive view and her friendliness toward the cronies are giving them great credibility. On Jan 24 this year, the US Department of Treasury removed U Kyaw Thein, a close business associate of Tay Za, from its targeted sanctions list (Specially Designated Nationals). When the Treasury announced its sanctions on Tay Zay and his financial network back in February 2008, U Kyaw Thein, who is a permanent resident of Singapore and director of Tay Za's companies in Singapore, was said to be the key financial front man of Tay Za. While there are so many cronies out there in Myanmar exploiting the lives of ordinary citizens and monopolising the country's economy, we may see more and more cronies being freed from US sanctions. No one else should come off the sanctions list since none of the benchmarks outlined by President Obama have been met and the situation has worsened since his visit to Myanmar.

တရားဥေဒစိုးမိုးေရး အတြက္ အေရးအၾကီးဆုံးလိုအပ္ခ်က္တစ္ရပ္က လြတ္လပ္တဲ့တရားစီရင္ေရးစံနစ္       (Independent Judiciary System) တည္ေဆာက္ဖို႕ပါ၊ တရားသူၾကီးေတြဟာ မိမိတို႕ရာထူးတည္ျမဲေရးအတြက္ ဘယ္သူ႕ကိုမွ မွီခိုမေနရဖို႕၊ ဘယ္သူ႕မ်က္ႏွာကိုမွ ငဲ့ၾကည့္မေနရဖို႕လိုပါတယ္၊ သူ႕ရဲ့ ရာထူးတည္ျမဲေရးဟာ သူကိုင္တြယ္ေျဖရွင္းရတဲ့ အမႈအခင္းေတြကို သူ မွန္မွန္ကန္ကန္ ဆုံးျဖတ္ျခင္းရွိ၊ မရွိ ဆိုတဲ့အေပၚမွာပဲ တည္မွီရပါမယ္၊
အေမရိကန္ ျပည္ေထာင္စုမွာ တရားသူၾကီးေတြကို ျပည္ေထာင္စုအဆင့္တရားသူၾကီးမ်ား နဲ႕ ျပည္နယ္အဆင့္ တရားသူၾကီးမ်ားလို႕ ႏွစ္ပိုင္းခြဲျခားထားပါတယ္၊ ျပည္ေထာင္စုအဆင့္ တရားသူၾကီးမ်ားကို သမၼတက ေရြးခ်ယ္ အဆိုျပဳျပီး အထက္လႊတ္ေတာ္က စစ္ေဆးအတည္ျပဳေပးရပါတယ္၊ သမၼတက တရားသူၾကီး တေယာက္ကို ခန္႕အပ္ဖို႕အဆိုမျပဳခင္ အခ်ိန္အေတာ္ယူျပီး အရည္အခ်င္းျပည့္ဝတဲ့ ပုဂိၢဳလ္၊ ျပစ္ခ်က္အနာအဆာမရွိတဲ့ ပုဂိၢဳလ္မ်ိဳးကို ထပ္ခါထပ္ခါ စစ္ေဆးရွာေဖြရပါတယ္၊ အထက္လႊတ္ေတာ္က သမၼတ အမည္စာရင္းတင္သြင္းတဲ့ ပုဂိၢဳလ္ကို ပညာအရည္အခ်င္းေတြ ျပည့္စံု႐ံုနဲ႕ အတည္ျပဳမွာ မဟုတ္ပါ၊ အဲဒီ ပုဂိၢဳလ္ ရဲ့ အတိတ္သမိုင္းတေလွ်ာက္လုံးက ေဆာင္ရြက္ခ်က္ေတြကို ႏိႈက္ႏိႈက္ခြၽတ္ခြၽတ္ ေလ့လာသုံးသပ္ၾကတာပါ၊ 

အဓိကကေတာ့ ဒီပုဂိၢဳလ္ရဲ့ Judiciary Philosophy  လို႕ေခၚတဲ့ ဥပေဒဆိုင္ရာအေတြးအေခၚကို အေလးအနက္ထားၾကည့္ၾကပါတယ္၊ ေသဒါဏ္အေပၚ ဘယ္လိုသေဘာထားသလဲ၊ အမ်ိဳးသမီး အခြင့္အေရးအေပၚ ဘယ္လိုသေဘာထားသလဲ စသျဖင့္၊ ဒီပုဂိၢဳလ္ ဆုံးျဖတ္ခဲ့တဲ့ အမႈေဟာင္းေတြ၊ ေရးခဲ့တဲ့ ဥပေဒစာတမ္းေတြ၊ ေဆာင္းပါးေတြ၊ အင္တာဗ်ဴးေတြ ကိုလဲ ေလ့လာအပစ္ရွာၾကပါတယ္၊ လူထုအေျချပဳအဖြဲ႕အစည္းမ်ားက တင္သြင္းၾကတဲ့ ေထာက္ခံမႈ၊ ကန္႕ကြက္မႈ စတဲ့ လူထုအျမင္ (Public Opinion) ေတြကိုလဲ ထည့္သြင္းစဥ္းစားပါတယ္၊ အထက္လႊတ္ေတာ္ တရားစီရင္ေရးေကာ္မီတီ (Senate Committee on Judiciary) က အမ်ားျပည္သူတက္ေရာက္ခြင့္ရွိတဲ့ ၾကားနာပြဲ (Confirmation Hearing) က်င္းပျပီး ဒီ အဆိုျပဳခံရတဲ့ ပုဂိၢဳလ္ကို ေမးခြန္းေတြေမးၾက၊ ေဝဘန္ၾကပါတယ္၊ အဲဒီေနာက္ ေကာ္မီတီ အဆင့္မွာ မဲခြဲ၊ ေကာ္မီတီ အဆင့္မွာ အႏိုင္ရမွ အထက္လႊတ္ေတာ္တစ္ခုလုံးက မဲခြဲဆုံးျဖတ္ၾကတာပါ၊ ဒါေၾကာင့္ သမၼတ အဆိုျပဳတဲ့ ပုဂိၢဳလ္တိုင္း တရားသူၾကီး ျဖစ္လာတာ မဟုတ္ပါ၊

ဒါေပမည့္ အဲဒီ အဆင့္ေတြကို ျဖတ္သန္းေအာင္ျမင္ျပီး တရားသူၾကီးအျဖစ္ အတည္ျပဳခန္႕အပ္ခံရျပီးတဲ့အခါမွာေတာ့ ရာသက္ပန္ခန္႕အပ္ျခင္းခံရတာ (Lifetime Appointment) မို႕   အဲဒီ တရားသူၾကီးဟာ သူ႕ရဲ့ ရာထူးတည္ျမဲေရးအတြက္ သူ႕ကို ေရြးခ်ယ္အဆိုျပဳတဲ့ သမၼတကိုေရာ သူ႕ကို အတည္ျပဳေပးတဲ့ အထက္လႊတ္ေတာ္ကိုေရာ မွီခိုစရာမလိုေတာ့ပါ၊ လြတ္လပ္စြာ တရားစီရင္ႏိုင္ပါျပီ၊ သူ မွားယြင္းျပီး၊ အက်င့္ပ်က္ျပီး လြဲမွားတဲ့ တရားစီရင္မႈမ်ိဳး ခ်မိမွပဲ သူ႕ရာထူးအတြက္ အနၱရာယ္ရွိပါလိမ့္မယ္၊ သူ႕ရဲ့ တရားစီရင္ ဆုံးျဖတ္ခ်က္ေတြကိုလဲ တရားစီရင္ေရးစံနစ္ကို ေစာင့္ၾကပ္ေဝဘန္ေနတဲ့ လူထုအေျချပဳအဖြဲ႕အစည္းမ်ား၊ သတင္းမီဒီယာမ်ားက မျပတ္ေစာင့္ၾကည့္ေနၾကတာမို႕ သူမွားရင္ မွားသလို ျပႆနာေတြ႕မွာပါ၊ ဒီေတာ့ အေမရိကန္ ျပည္ေထာင္စုရဲ့ တရားသူၾကီး ေရြးခ်ယ္ပံုကို အက်ဥ္းခ်ဳပ္ေျပာရရင္ သမၼတကလဲ အေကာင္းဆုံး၊ အသန္႕ရွင္းဆုံးလူကို ေရြးခ်ယ္အဆိုျပဳတယ္၊ အထက္လႊတ္ေတာ္ကလဲ အေကာင္းဆုံး၊ အသန္႕ရွင္းဆုံးျဖစ္မွ အတည္ျပဳေပးတယ္၊ ျပီးရင္ တရားသူၾကီးေတြဟာ ရာသက္ပန္ တာဝန္ထမ္းေဆာင္ခြင့္ရွိတာမို႕ အဲဒီတရားသူၾကီးကို သမၼတကေရာ၊ လႊတ္ေတာ္ကေရာ ထုတ္ပယ္ခြင့္မရွိ၊ သူ႕ရဲ့ တရားစီရင္မႈမွာ ဝင္ေရာက္ စြက္ဖက္ခြင့္မရွိ၊ တရားသူၾကီးကလဲ သမၼတ နဲ႕ လႊတ္ေတာ္ကို ေၾကာက္ေနဖို႕မလို၊ ဒါေပမည့္ သူ႕ရဲ့ တရားစီရင္မႈကို ေစာင့္ၾကပ္ၾကည့္႐ႉေဝဘန္ေနမည့္ လူထုအဖြဲ႕အစည္းမ်ား၊ သတင္းမီဒီယာမ်ားက သူမွားရင္ မွားသလို ရွုပ္ခ်ဖို႕ အဆင္သင့္ ရွိေနၾက၊ ဒီလိုနဲ႕ လြတ္လပ္တဲ့ သန္႕ရွင္းတဲ့ တရားစီရင္ေရးစံနစ္ကို တည္ေဆာက္ၾကရပါတယ္၊

က ျပည္ေထာင္စုအဆင့္တရားသူၾကီးမ်ားကိုသာမက တိုင္းေဒသၾကီး နဲ႕ ျပည္နယ္အဆင့္တရားသူၾကီးမ်ားကိုပါ ခန္႕အပ္ပိုင္ခြင့္ရွိပါတယ္၊ သမၼတက သူခန္႕အပ္တာဝန္ေပးခ်င္တဲ့ တရားသူၾကီးေလာင္းမ်ားရဲ့ အမည္စာရင္းကို ျပည္ေထာင္စုလႊတ္ေတာ္ကို တင္သြင္းရမွာ ျဖစ္ေပမည့္ ၎ပုဂိၢဳလ္မ်ားဟာ သတ္မွတ္ထားတဲ့ အရည္အခ်င္းမ်ားနဲ႕ မျပည့္စံုေၾကာင္း အထင္အရွားမျပႏိုင္ပါက ျပည္ေထာင္စုလႊတ္ေတာ္က သမၼတအဆိုျပဳသူကို ျငင္းပယ္ခြင့္မရွိပါ၊ ဒီျဖစ္စဥ္မွာ လူထုက ပါဝင္ပါတ္သက္ခြင့္၊ အၾကံျပဳခြင့္၊ ကန္႕ကြက္ခြင့္ လဲမရွိပါ၊ တခါ ေရြးခ်ယ္ခန္႕အပ္လိုက္တဲ့ တရားသူၾကီးမ်ားဟာ ျပည္ေထာင္စုအဆင့္ဆိုရင္ အသက္ ၇၀ အထိ၊ တိုင္းေဒသၾကီး နဲ႕ ျပည္နယ္အဆင့္ဆိုရင္ အသက္ ၆၅ ႏွစ္အထိပဲ အမႈထမ္းခြင့္ရွိပါတယ္၊ ဒီလိုနဲ႕ တရားသူၾကီးမ်ားဟာ လြတ္လပ္စြာတရားစီရင္ႏိုင္တဲ့ အေနအထားမွာ မရွိပဲ သမၼတကို သစၥာခံရတဲ့ သမၼတရဲ့ လက္ေအာက္ခံဝန္ထမ္းမ်ားသဖြယ္ျဖစ္လာပါတယ္၊ ျမန္မာႏိုင္ငံရဲ့ တရားစီရင္ေရးစံနစ္ ကလဲ အုပ္ခ်ဳပ္ေရး၊ ဥပေဒျပဳေရးအာဏာမ်ားနဲ႕ တန္းတူရည္တူ အာဏာပိုင္အဖြဲ႕အစည္းျဖစ္ရမည့္ အစား အစိုးရအဖြဲ႕ရဲ့ လက္ေအာက္ခံ ယနၱရား တခုအျဖစ္ ျပီးခဲ့တဲ့ စစ္အစိုးရမ်ား လက္ထက္ကအတိုင္း ဆက္ျဖစ္ေနပါတယ္၊

အဲဒီလို သမၼတ လက္ေအာက္ခံျဖစ္ေနတဲ့ တရားသူၾကီးေတြဟာ အခုေတာ့ လႊတ္ေတာ္ကိုပါ ေၾကာက္ေနရျပန္ပါျပီ၊ ဘယ္အခ်ိန္မွာ ငါတို႕ကို ဖိတ္ၾကားျပီး ဩဝါဒ ေတြေခြၽမလဲ၊ ဘယ္အခ်ိန္မွာ ငါ့တရားရုံးကို ေရွာင္တခင္ စစ္ေဆးမလဲ၊ စသျဖင့္ မလြတ္လပ္တဲ့ တရားစီရင္ေရးစံနစ္ထဲက မလြတ္လပ္တဲ့ တရားသူၾကီးေတြ ျဖစ္ေနၾကပါျပီ၊ ဒီပံုနဲ႕ေတာ့ တရားဥပေဒစိုးမိုးေရးဆိုတာ ေဝးသထက္ေဝးေနပါဦးမယ္၊

တရားဥပေဒ စိုးမိုးဖို႕အတြက္ အေရးအၾကီးဆုံးက ခိုင္မာအားေကာင္းတဲ့ လြတ္လပ္သန္႕ရွင္းတဲ့ တရားစီရင္ေရးစံနစ္ ကို တည္ေဆာက္ဖို႕ျဖစ္ပါတယ္၊ အုပ္ခ်ဳပ္ေရးအာဏာကိုင္တြယ္တဲ့ အစိုးရ နဲ႕ ဥပေဒျပဳအာဏာကိုင္တြယ္တဲ့ လႊတ္ေတာ္တို႕က တရားစီရင္ေရးဆိုတာ ၎တို႕ အာဏာပိုင္အဖြဲ႕အစည္းမ်ားနဲ႕ တန္းတူအဖြဲ႕အစည္းဆိုတာ လက္ခံဖို႕ အသိအမွတ္ျပဳဖို႕လိုပါတယ္၊ ျပီးေတာ့ အဲဒီတရားစီရင္ေရးစံနစ္ကို လြတ္လပ္ေစဖို႕လိုပါတယ္၊ တရားသူၾကီးမ်ားက အစိုးရကိုေရာ၊ လႊတ္ေတာ္ကိုေရာ မေၾကာက္ေနရေအာင္ ဖန္တီးေပးဖို႕လိုပါတယ္၊ 

သမၼတကလဲ တရားသူၾကီးေလာင္းမ်ားကို ေရြးခ်ယ္ရာမွာ အေကာင္းဆုံးအသန္႕ရွင္းဆုံးေတြကို ေရြးခ်ယ္ဖို႕လိုပါတယ္၊လႊတ္ေတာ္ကလဲ အေကာင္းဆုံး၊ အသန္႕ရွင္းဆုံး မဟုတ္ရင္ ျငင္းပယ္ႏိုင္တဲ့ အာဏာရွိရပါမယ္၊ လူထုကလဲ တရားသူၾကီးေလာင္းအေပၚ သူတို႕ရဲ့ သေဘာထားအျမင္ကို တင္ျပခြင့္ရွိရပါမယ္၊ ဒီအဆင့္ေတြကို ျဖတ္ေက်ာ္ျပီး ခန္႕အပ္ခံရတဲ့ တရားသူၾကီး ဟာ သူ႕ရာထူးတည္ျမဲေရးအတြက္ သမၼတကိုေရာ၊ လႊတ္ေတာ္ကိုေရာ မမွီခိုေနရသင့္ပါဘူး၊ လူထု နဲ႕ လူအခြင့္အေရးေရွ႕ေနအဖြဲ႕ေတြ၊ သတင္းမီဒီယာေတြကိုလဲ တရားစီရင္ေရးစံနစ္၊ တရားစီရင္မႈေတြကို မ်က္ေျခမျပတ္ ေလ့လာသုံးသပ္ေနဖို႕ အားေပးသင့္ပါတယ္၊ ဒီလိုမွပဲ က်ေနာ္တို႕ ႏိုင္ငံဟာ တရားဥပေဒစိုးမိုးေရး နဲ႕ နီးလာမွာပါ၊
